Two gay men who say they face unjustified barriers to publicly-funded fertility treatment have taken their case to the Northern Ireland Court of Appeal.
The men had asked a woman to act as a surrogate for them, but because she had previously undergone voluntary sterilisation she is not eligible for publicly-funded IVF.
Ronan Lavery KC, acting for the men, said that revised criteria for publicly-funded IVF has opened the door for all-female couples, but that there is no equivalent provision for men in same sex relationships.
