A couple who require the use of a surrogate in order to have children have been told they can not commence IVF until they have secured a court approval for a surrogate.
The couple had applied to the court to be permitted to commence with IVF treatment to create embryos to be frozen which would later be transferred to a surrogate. However, they were told that as South African law necessitates court approval of a surrogate before commencing 'artificial fertilisation', they were not permitted to create embryos before securing this, IOL reported.
