A long-running IVF embryo custody battle between a divorced couple (see BioNews 1283) appears to have reached a legal impasse.
On 25 April 2025, the Michigan Supreme Court declined to intervene in the dispute. The court held that 'the facts in this matter are unique and do not present a good vehicle to address the weighty issues arising from in vitro fertilisation and the human embryos created in the process'.
Justice Brian Zahra wrote, 'the court should not decide the case.' He argued that it highlights 'significant policy questions' that would be 'most appropriately resolved' by lawmakers.
