A father-and-son duo has been barred by the Superior Court of Quebec in Canada from making or offering any further sperm donations.
Philippe Normand and his son, Dominik Seelos, are believed to be linked to at least 613 births or ongoing pregnancies. Another son, Raphaël Normand, was previously a sperm donor but stopped in 2020. Justice Simon Chamberland of the Superior Court of Quebec in Montreal granted the injunction, which will remain in place until a trial determines whether the men will be permanently prohibited from sperm donation.
'Their continued conduct created significant harm to our client and her children,' Jessica Lelièvre, the lawyer representing the plaintiff, told the National Post. 'Knowing that they can no longer donate their sperm while we prepare for trial provides important protection for our client and safeguards the rights and well-being of her children. It definitely lifts an important weight off our client's shoulders.'
Chamberland noted in his ruling that the injunction was necessary given the men's apparent intention to continue donating throughout the proceedings. He also highlighted how such a high number of donations could lead to an increased risk of half-siblings unknowingly entering relationships with one another, as well as the potential psychological impact on donor-conceived children.
One of the recipients of Normand's and Seelos' donations, known by the pseudonym 'Laurie', brought the case, alleging 'fertility fraud' and violations of her dignity 'both on contractual grounds and on fundamental rights'. She conceived three children using Normand's sperm between 2009 and 2012, and a fourth child with Seelos' sperm in 2017 – each time via private arrangements. Several other mothers were present in court during the hearing.
The plaintiff alleges that the two men failed to disclose that they were related, and that they misrepresented the number of children they had already fathered through donation. She also claims that they had agreed to stop being donors once a certain number of births or recipient families had been reached.
However, Normand previously indicated that, if the injunction was granted, he would continue donating in Ontario, Canada, where the ruling does not apply.
Normand and Seelos were the focus of a 2023 documentary titled Père 100 enfants (see BioNews 1311 and 1238), which prompted the Quebec government to consider establishing a sperm, egg, and embryo donor registry. There is currently no legal limit on the number of sperm donations in Quebec.
Similar 'mass sperm donor' cases have emerged in other countries, including the UK and the Netherlands (see BioNews 1247, 1277 and 1281), raising concerns about regulations and the risks associated with informal sperm donation.
