The couple, from Illinois, used the Harmony NIPT test, the results of which said their child did not have Trisomy 21, the genetic cause of Down's syndrome, but their child did in fact have the condition.
A federal court has dismissed their claim of negligence related to the test, but the couple may proceed with their claim of fraud, based on an online advertisement claiming a 100 percent detection rate for Trisomy 21.
